Terms of Service

1. Agreement

By engaging Clarity Digital Agency ("Clarity") for any platform solution, you agree to these Terms of Service. These terms govern the relationship between Clarity and the client for all services rendered through the Clarity Marketplace.

2. Services

Clarity provides structured digital platform solutions including design, development, and managed infrastructure services. All deliverables are defined within the scope of the selected solution package and tier.

3. Pricing & Payments

All prices listed are starting prices and may vary based on specific requirements. Final pricing is confirmed in the structured proposal. Proposals are valid for 30 days from the date of issue. Payment terms are outlined in the individual project agreement.

4. Scope of Work

Any functionality not explicitly listed in the selected package is considered outside the defined scope and may require a separate quotation. Changes to scope after project commencement may affect timeline and cost.

5. Client Responsibilities

The client is responsible for providing all necessary content, credentials, and approvals in a timely manner. The client is also responsible for establishing and maintaining their own payment processor accounts where applicable.

6. Intellectual Property

Upon full payment, the client owns all custom content and data created for their platform. Clarity retains rights to underlying code frameworks, templates, and methodologies used across projects.

7. Third-Party Services

Third-party plugin and service functionality cannot be guaranteed 24/7. Clarity is not liable for disruptions caused by third-party providers, changes to their APIs, or service discontinuations.

8. SEO Disclaimer

All platforms are delivered SEO-ready with proper technical foundations. Content SEO strategy, keyword research, and ongoing optimization are not included unless explicitly stated in the project scope.

9. Limitation of Liability

Clarity's liability is limited to the total fees paid for the specific service in question. Clarity is not liable for indirect, incidental, or consequential damages.
